§ 1 Basic Provisions

(1) The following terms and conditions apply to contracts concluded between you and us as the provider (Augustine Fuerst) via the website culturetribe.de. Any conflicting terms and conditions of the customer are hereby excluded unless expressly agreed otherwise.

(2) A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
An “entrepreneur” is any natural or legal person or partnership acting in the course of their business or professional activity.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By listing products on our website, we make a binding offer to conclude a contract under the conditions specified in the respective product description.

(3) The contract is concluded via the online shopping cart system as follows:

  • Products are placed in the shopping cart

  • The shopping cart can be accessed and modified at any time

  • After clicking “Checkout” (or similar), you enter your personal data and select payment and shipping methods

  • An order summary is displayed

If you use a payment provider (e.g. PayPal, Klarna, Amazon Pay), you may be redirected to their platform to complete payment.

Before submitting your order, you may review, modify, or cancel it.

By clicking the order button (e.g. “Buy now”, “Pay now”, “Order with obligation to pay”), you accept the offer and a binding contract is formed.

(4) Order processing and communication take place via email. You must ensure that your email address is correct and able to receive emails.

§ 3 Payment Methods

(1) Klarna / SOFORT
Payments may be processed via Klarna Bank AB (Stockholm, Sweden). You must have access to online banking and confirm the payment.

Payments are processed via PayPal (Europe) S.à.r.l. et Cie, S.C.A., Luxembourg.

§ 4 Retention of Title

(1) Goods remain our property until full payment has been made.

(2) For business customers, we retain ownership of goods until all claims arising from the business relationship have been settled.

§ 5 Warranty

(1) Statutory warranty rights apply.

(2) Customers are requested to inspect goods upon delivery and report any visible defects or transport damage promptly. Failure to do so does not affect statutory rights.

(3) Deviations from product specifications only apply if expressly agreed.

(4) For business customers:

  • Warranty period is one year from delivery

  • Remedy is at our discretion (repair or replacement)

  • Liability exclusions apply as permitted by law

§ 6 Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for indirect, incidental, or consequential damages.

Nothing in this section limits liability where prohibited by law (e.g. injury, intent, gross negligence, or mandatory consumer rights).

§ 7 Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this applies only insofar as it does not restrict mandatory consumer protection laws of their country of residence.

3. Contract Language and Storage

(1) Contract language: English (or German where applicable)

(2) We do not store the full contract text. Before submitting your order, you may print or save the order details. After ordering, you will receive all relevant information via email.

4. Product Information

The essential characteristics of the goods can be found in the respective product descriptions.

5. Prices and Payment Terms

(1) All prices are total prices including applicable taxes.

(2) Shipping costs are not included unless explicitly stated and will be displayed during checkout.

(3) Additional costs (e.g. customs duties, taxes, bank fees) may apply for deliveries outside the EU.

(4) Payment methods are displayed on the website.

(5) Payments are due immediately unless otherwise agreed.

6. Delivery Conditions

(1) Delivery times and conditions are stated on the website or product pages.

(2) For consumers: risk transfers upon delivery.
For business customers: shipping is at your own risk.
